In case you do not know about Joe:  He is the most experienced builder and most knowledgeable pilot that I know.   He had a major engineering position at Boeing and I did not know that he retired.   That project must be the best that a new builder can find or do themselves.

Seen today.  I have welded my own EZ stainless exhaust from the Cozy plans.  It is still flying although Marc fixed a crack last year.  A fun skill to develop and at the prices they go for, maybe a good sideline business.

Barnstormers:  Rather pricey for the amount of work left to do but maybe with the Garmin and extra stuff. . ..  More pics in the ad.  Seller also listed an eracer project not long ago.

This Varieze on Ebay in Sandersville, GA for $5000.  Item #  334297873028     Good price but a search of the registry does not show a former Airworthiness Certificate (pic 3).  I found a partial message dated 2/19/01 where the registered owner Steichen says he is selling it as parts.  Current seller is the new owner, it appears.  So there are two things to sort out: Can a buyer establish a chain of title from the registered owner (Steichen) and (2) Does the FAA have a record of the former A.C. which can be reissued

It just goes to show the stupidity of selling an airplane as parts in order to avoid liability.  This airplane will be flying again, probably, and can be traced back to the builder.  So whatever liability he was afraid of, it's is still there.  If you are new to EAB, there has never been a successful lawsuit against a builder for a defective EAB airplane, AFAIK.  It's just too hard to prove negligence, the old builder has no insurance to collect on, and the puny award would not interest a lawyer to take the case

Apparently the original builder John Steichen flew this airplane but sold it for parts and kept the A.C.. If the N-number is known and a copy of the old Airworthiness Certificate can be obtained from the FAA in OK City, it could be reissued. However, Steichen is the registered owner in the FAA Registry. If you don't have an acceptable bill of sale from Steichen, the FAA will not let your buyer reregister the airplane in his name. This is probably something you should discuss in your ad.

Seller Replied:   We have been in touch with the FAA and they have us as the owner but we have to send photos of the data plate and the aircraft assembled and ready to fly at that point the will reissue an AW and return to the registry. Other option given is have a DAR come in and view the plane ready to fly at which point the DAR will issue a new AW which is the faster way to get it done. We have a plane in our shop now that we are going through that process and has been painless. Bill of sale keeps up the chain of custody which is what you see now if you check the FAA site. It shows sale reported and list our info.

I said:  Hi, I'm not trying to make trouble for you but I searched the FAA Registry a bunch of ways and see no indication of an ownership change so I'm not sure what you mean by "the FAA has you as the owner". Yeah, you could get the AW reissued but I have a friend who just went through this with an EZ. That airplane was flying but it had been grounded for a long time and the old AW certificate was apparently purged from the records so the FSDO will not reissue one. [Added: Or it never had one]   If someone represents it is a new build and applies for an AW, he'll have to lie on the FAA forms. I suppose this is why it didn't sell. I suggest getting it registered properly in your name and writing to OK City and getting a copy of the old AW (if it's still in the records). That only costs $10 and it will reassure buyers they could get it flying again. Regards -Kent

Seller replied: My husband and I own [a company] and do all this for a living. I don't know what your friend did but everything with the FAA changes based on what person you talk to and what day that conversation happens. My husband's out look is everything is going to want it for nothing and not understand that to do to make it fly again causing him a bunch of headaches. [emphasis mine]  His opinion is to just cut it up and send it to the dump since we are in a real need of space in our shop as we are working to become a part 145 for composite repairs. I'm of the opinion someone will get a fun project without having to make a huge investment, so we will list it one more time before I have to conceded to him.

They did not change the ad except the price.  At some price, maybe it's worth buying "a bunch of headaches".  If I wanted to buy this one, I'd apply to the FAA Registry for a copy of the old Airworthiness Certificate.  If there is one, it can be reissued.  Then I'd want to see the bills-of-sale from former registered owner Steichen and confirm a FSDO will accept them.  Good luck, palies!   🙂

More on the Varieze above:  It turns out that the N-Number is apparently N67EZ HazelRigg Very Ezy built by TJ HazelRigg and was a flier, last owned by Tony Warnock.  It is in the Registry partially registered to the Seller   https://registry.faa.gov/AircraftInquiry/Search/NNumberResult?nNumberTxt=67EZ       The seller apparently has good title,  so if the buyer can retrieve a copy of the old A.C. from the registry, it should be pretty straightforward to get this flying again (except a pile of work to do).  The ad said "Sold" when I looked this morning but now it doesn't so I guess it's available.

Edit:  Well, I am confused.  I see that a replacement A.C. can be issued with an "R" per the Order below but it must reflect the same data as the lost, mutilated or illegible old certificate.  Per para 3 below the FAA can issue a replacement A.C. if the date of issuance of the old A.C. can be established.   The FSDO wants to find the old A.C. information in the FAA's records to confirm the information but for N67EZ, but I do not see any A.C. date in the record and I've been told the FSDO consults the same database.   It WAS a flyer so it HAD an A.C. in the past but the FAA purges it's records periodically.  If the record has been purged, can it be retrieved?  The National Archives says yes but I tried this for a friend and we never found anything.  I would think a FSDO would not want to reissue an A.C. without any info from the old A.C.  Also, I do not think the FAA wants to issue a brand new A.C. for an airplane that once had an A.C.  Maybe this is why this airframe is not selling.

the original issue date of the certificate being replaced, preceded by a capital “R” in the Date block of
the certificate. Replacement certificates also will be issued when the aircraft registration number has
been changed. In these cases, a new application for airworthiness certification is not required.

(2) Request for a replacement certificate will be made to the applicable certification office. The
registered owner or certificate operator will certify this by submitting a signed statement containing the
registration number (N-Number), serial number, make, and model of the aircraft, and a reason the

by verbal agreement with the assigned ASIs or through procedures contained in air carriers’ manuals
that allow the continued operation of an aircraft without an airworthiness certificate. Such actions are
contrary to §§ 91.203(b) and 121.153(a)(1), and 14 CFR part 135, Operating Requirements: Commuter
and On-Demand Operations and Rules Governing Persons on Board Such Aircraft, § 135.25(a).
(3) A replacement airworthiness certificate may be issued without supporting documentation
from AFS-750 if the date of issuance and the airworthiness classification and/or category of the lost
or mutilated certificate can be positively established from the aircraft records, or from the remains of the
certificate. If there is insufficient data on which to base issuance of the replacement certificate, the
FAA ASI will obtain the required data electronically, by telephone, or by mail (such as the application
form or previously issued airworthiness certificate) from AFS-750.
(4) Before issuing a replacement certificate, the FAA must review the aircraft records and, if
necessary, inspect the aircraft to ensure that the applicant’s request is justified and the aircraft is eligible
for the airworthiness certificate requested.
(5) A copy of the replacement certificate must be forwarded to AFS-750.
